Will the Disbelievers speak on the Day of Judgement?: Imam al-Shinqitee

In his book written to respond to supposed contradictions and difficult passages of the Qur’an, Sheikh Muhammad al-Ameen al-Shinqitee brought the following discussion under his treatment of surah al-Mursalat:

قَوْلُهُ تَعَالَى: هَذَا يَوْمُ لَا يَنْطِقُونَ وَلَا يُؤْذَنُ لَهُمْ فَيَعْتَذِرُونَ. هَذِهِ الْآيَةُ الْكَرِيمَةُ تَدُلُّ عَلَى أَنَّ أَهْلَ النَّارِ لَا يَنْطِقُونَ وَلَا يَعْتَذِرُونَ. ـ

Allah’s statement:

هَذَا يَوْمُ لَا يَنْطِقُونَ * وَلَا يُؤْذَنُ لَهُمْ فَيَعْتَذِرُونَ

This is a Day they will not speak, * Nor will it be permitted for them to make an excuse. [77:35-36]

This noble ayah indicates that the people of the Hell-fire will neither speak nor proffer excuses.

وَقَدْ جَاءَتْ آيَاتٌ تَدُلُّ عَلَى أَنَّهُمْ يَنْطِقُونَ وَيَعْتَذِرُونَ، كَقَوْلِهِ تَعَالَى: وَاللَّهِ رَبِّنَا مَا كُنَّا مُشْرِكِينَ [6 \ 23] ، وَقَوْلِهِ: فَأَلْقَوُا السَّلَمَ مَا كُنَّا نَعْمَلُ مِنْ سُوءٍ [16 \ 28] ، وَقَوْلِهِ: بَلْ لَمْ نَكُنْ نَدْعُو مِنْ قَبْلُ شَيْئًا [40] ، وَقَوْلِهِ: تَاللَّهِ إِنْ كُنَّا لَفِي ضَلَالٍ مُبِينٍ إِذْ نُسَوِّيكُمْ بِرَبِّ الْعَالَمِينَ وَمَا أَضَلَّنَا إِلَّا الْمُجْرِمُونَ [26 \ 97 – 99] ، وَقَوْلِهِ: رَبَّنَا هَؤُلَاءِ أَضَلُّونَا [7 \ 38] ، إِلَى غَيْرِ ذَلِكَ مِنَ الْآيَاتِ.ـ

But other ayaat have already come which indicates that they will speak and offer excuses, such as His statement:

وَاللَّهِ رَبِّنَا مَا كُنَّا مُشْرِكِينَ

[the disbelievers will say] “By Allah, our Lord, we were not those who committed al-shirk.” [6:23]

And His statement:

فَأَلْقَوُا السَّلَمَ مَا كُنَّا نَعْمَلُ مِنْ سُوءٍ

and those who then offer submission, [saying], “We were not doing any evil.” [16:28]

And His statement:

بَلْ لَمْ نَكُنْ نَدْعُو مِنْ قَبْلُ شَيْئًا

[the disbelievers will say] “rather, we did not used to invoke anything previously.” [40:74]

And His statement:

تَاللَّهِ إِنْ كُنَّا لَفِي ضَلَالٍ مُبِينٍ * إِذْ نُسَوِّيكُمْ بِرَبِّ الْعَالَمِينَ * وَمَا أَضَلَّنَا إِلَّا الْمُجْرِمُونَ

[the weak ones among the disbelievers will say to the strong ones among them] “By Allah, we were indeed in manifest error * When we equated you with the Lord of the worlds. * And no one misguided us except the criminals. [26:97-99]

And His statement:

رَبَّنَا هَؤُلَاءِ أَضَلُّونَا

[the disbelievers will say] “Our Lord, these ones had misled us!” [7:38]

As well as in other ayaat.

وَالْجَوَابُ عَنْ هَذَا مِنْ أَوْجُهٍ : ـ
الْأَوَّلُ: أَنَّ الْقِيَامَةَ مُوَاطِنُ فَفِي بَعْضِهَا يَنْطِقُونَ وَفِي بَعْضِهَا لَا يَنْطِقُونَ . ـ

And the answer to this comes from three angles:

First: That the Day of Judgement has multiple stations, so in some of them they will speak and in some others they will not speak.

الثَّانِي: أَنَّهُمْ لَا يَنْطِقُونَ بِمَا لَهُمْ فِيهِ فَائِدَةٌ وَمَا لَا فَائِدَةَ فِيهِ كَالْعَدَمِ . ـ

Second: That they will not utter anything which contains benefit for them, and that which contains no benefit is like an absence of any substance.

الثَّالِثُ: أَنَّهُمْ بَعْدَ أَنْ يَقُولَ اللَّهُ لَهُمْ: اخْسَئُوا فِيهَا وَلَا تُكَلِّمُونِ [23 108] . يَنْقَطِعُ نُطْقُهُمْ وَلَمْ يَبْقَ إِلَّا الزَّفِيرُ وَالشَّهِيقُ. قَالَ تَعَالَى: وَوَقَعَ الْقَوْلُ عَلَيْهِمْ بِمَا ظَلَمُوا فَهُمْ لَا يَنْطِقُونَ [27 85] ، وَهَذَا الْوَجْهُ الثَّالِثُ رَاجِعٌ لِلْوَجْهِ الْأَوَّلِ . ـ

Third: That this is after Allah will say to them:

اخْسَئُوا فِيهَا وَلَا تُكَلِّمُونِ

Remain despised therein and do not speak to Me [23:108]

So their speech will be cut off and nothing will remain except deep breaths and sighing. Allah said:

وَوَقَعَ الْقَوْلُ عَلَيْهِمْ بِمَا ظَلَمُوا فَهُمْ لَا يَنْطِقُونَ

And the decree will befall them for the wrong they did, and they will not speak. [27:85]

And this third angle goes back to the first angle.
